According to Decision No. 15/2008/QĐ-BCT released by the Ministry of Industry and Trade about the procedures of providing, revoking, managing and using the Power Operating License, The Ministry of Industry and Trade will license big power plants in the nominated list which have significant meaning with the socio-economic development and the national security.
The Electricity Regulatory Authority of Vietnam (ERAV) will provide Power Operating Licenses for power plants which have the capacity of at least 3 MW and are performing in areas like power wholesaling, retailing, distributing and consulting.
The licensing for the power plants which have the capacity below 3 MW will be done by the provinces’ People Committees under direct central management or the Ministry of Industry and Trade. Besides, these organs also licenses for some other activities such as rural power distribution or rural power retailing.
One of the most important requirements for the license is that power plants must have feasible projects on power construction which are suitable with the approved power development plan. The Power Operating License is provided with two phases: construction investment and commercial power generation in the whole plant.
The Ministry of Industry and Trade requires at least the intermediate degree in such areas as economics, finance or the similar ones and at least 5 years of experience in the field of power purchase with the managers of power wholesaling or retailing. For power retailing in rural areas, the managers must have fulfilled these courses and only 2 years of experience in power purchase.
